Privacy Policy for California Residents

Consumers residing in California have specific privacy rights under the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws relating to the collection, use and sharing of their personal information. This Privacy Notice for California Residents (“California Privacy Notice”) supplements the information provided in FleetPride’s Privacy Policy (“Privacy Policy”) as it applies to California consumers, any terms defined in the CCPA have the same meaning when used in this section.

Collection, Use, and Disclosure of Personal Information.

As explained in the “Information We Collect About You and How We Collect It” and “How We Use It” sections of the Privacy Policy, we may collect certain personal information about you from various sources for business or commercial purposes. In addition, we may disclose your personal information to our service providers as described in the “Disclosure of Your Personal Information” section of the Privacy Policy.

Your Rights and Choices.

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Access and Data Portability.

You have the right to request access to your personal information or confirmation that we have information about you. In certain limited circumstances, you may also request to receive access to your data in a portable, machine-readable format:

Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies.

We may deny your deletion request if retaining the information is necessary to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purposes.

Right to Request Changes

We rely on you to update and correct your personal information. You may ask us to correct information that is inaccurate or incomplete. Note that we may keep historical information in our backup files as permitted by law.

Exercising Your Rights

To exercise your rights to know or delete described above, please submit a request through our website by clicking here.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may also make a request to know or delete on behalf of your child.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact legal@fleetpride.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response electronically, unless you direct us to deliver it via mail.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal.” For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

California Sensitive Information Disclosure

We collect the following categories of sensitive personal information (as defined under California law): precise geolocation data and government identifiers such as a driver’s license or social security card. This information is collected in order to process transactions, comply with laws, manage our business, or provide you with services. Note that we do not use such information for any purposes that are not identified within the California Privacy Rights Act Section 1798.121. We do not “sell” or “share” sensitive personal information for purposes of cross-context behavioral advertising.

Changes to Our California Privacy Notice

We reserve the right to amend this California Privacy Notice at any time, and we will post any changes we make on this page with an updated effective date. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy policy to check for any changes.
